Terms of Use

These terms are an agreement between you and Ophelia Creations (“we”, “us”) about your use of the esther app (“esther” or “the app”). By creating an account or using esther, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the app.

1. Who can use esther

You must be at least 13 years old to use esther. If you’re under the age of majority where you live, you need a parent’s or guardian’s permission. You’re responsible for keeping your Apple ID secure and for what happens in your account.

2. Your subscription and free trial

• esther offers a yearly subscription, esther Premium, for $57 per year (or the local equivalent shown in the app), with a 7-day free trial for new subscribers.
• Payment is charged to your Apple ID when the free trial ends, unless you cancel at least 24 hours before it ends.
• Your subscription renews automatically every year at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
• Cancel anytime in iOS Settings → [your name] → Subscriptions → esther. Canceling stops future renewals; you keep access until the end of the period you’ve paid for or the end of the trial.
• Deleting the app or your esther account does not cancel your subscription. Please cancel it in Settings as above.
• Payments and refunds are handled by Apple under Apple’s terms. To request a refund, visit reportaproblem.apple.com.
• If we ever change the price, we’ll tell you in advance, and Apple will ask for your consent where required.

3. Content in esther

• esther’s summaries, headlines, key findings and action steps are written by us, in our own words, about published works. Each summary credits and links to its original source. The original works belong to their authors and publishers.
• Summaries are simplifications. They may leave out details, limits or nuances of the original research. Read the original source before relying on a finding.
• Artwork in the app is from public collections, credited where it appears.
• Links to papers, books and articles go to third-party websites that we don’t control. We’re not responsible for their content, availability or practices.
• All other content and design in esther, including its text, look and software, belongs to Ophelia Creations and is protected by law.

4. Links you share to esther

When you share a link to esther from another app, we save the web address and its title in your account so it can be added to your reading plan. esther doesn’t visit, copy or read the page. You’re responsible for the links you save.

5. Your license to use esther

We give you a personal, non-exclusive, non-transferable, revocable license to use esther on Apple devices you own or control, as allowed by Apple’s Usage Rules in the App Store Terms of Service. You agree not to:

• copy, resell, redistribute or publish esther’s content outside the app, except for brief personal quotes with credit;
• scrape, reverse-engineer or interfere with the app or its servers;
• use esther for anything illegal or harmful, or to infringe anyone’s rights.

6. Ending your account

You can delete your account at any time in the app (Profile → Delete account). We may suspend or end your access if you seriously or repeatedly break these terms. Sections that by their nature should continue after your account ends will continue, including sections 3, 7, 8 and 9.

7. Disclaimers

esther is provided “as is” and “as available”. To the fullest extent allowed by law, we make no warranties, express or implied, including about accuracy, completeness, fitness for a particular purpose or uninterrupted availability. Research findings change over time, and summaries may contain errors.

8. Limitation of liability

To the fullest extent allowed by law, Ophelia Creations is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of esther. Our total liability for any claim relating to esther is limited to the amount you paid us for esther in the 12 months before the claim. Some places don’t allow these limits, so they may not all apply to you.

9. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, except where the law of your country of residence requires otherwise.

10. Apple

• These terms are between you and Ophelia Creations only, not Apple. Ophelia Creations, not Apple, is solely responsible for esther and its content.
• Apple has no obligation to provide maintenance or support for esther.
• If esther fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for esther. To the maximum extent permitted by law, Apple has no other warranty obligation for esther.
• Ophelia Creations, not Apple, is responsible for addressing any claims by you or third parties relating to esther, including product liability claims, claims that esther fails to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that esther or your use of it infringes a third party’s intellectual property rights.
• You confirm that you’re not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you’re not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using esther.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

11. Changes to these terms

We may update these terms from time to time. We’ll change the date at the top and, for significant changes, let you know in the app. If you keep using esther after a change takes effect, you accept the updated terms.
